A Real Estate Company acting as a "buyer's agent" must do what is right for the
buyer.
This relationship is established through a written contract called a "buyer agency
agreement". It explains the services the company/agent will provide and ensures that
confidences that a buyer shares with the buyers agent must be kept confidential.
Although confidential information about the buyer cannot be disclosed a seller
working with a buyers agent can expect to be treated honestly and fairly.
Unless the seller cannot or is not offering to pay a commission a Buyer working with an
agent in buyer agency will not be expected to pay commission. The commission will be
paid from the sellers/transaction proceeds. In some cases the buyer is paying commission as in the case of buying a property that is not listed for sale.
In this agreement the buyer agrees in writing to work exclusively with the agent for
a specific period of time to find a property.
