Dual Agent
Occasionally a Real Estate Company will be the agent of both the buyer and the seller.
The buyer and seller must consent to this arrangement in their "listing" and "buyer agency
agreements" as well as when an offer is presented along with the "confirmation of co-operation
and representation" form.
The agent shall not disclose that the seller may or will accept less than listed price.
The agent shall not disclose that the buyer may or will pay more than the offered price.
The agent shall not disclose to either party motivation or personal information about the other
party.
The agent shall not disclose the price the buyer should offer or the price the seller should
accept.
The agent shall not disclose to the buyer the terms of any other offer.
